One of the first questions we get on every deck project is: do I need a permit? The answer in Louisville is almost always yes — and getting it wrong can create serious problems when you sell your home. Here's what you need to know.
Any deck that is attached to the house OR more than 30 inches above grade (ground level) requires a building permit in Louisville-Jefferson County. This covers the vast majority of decks. Freestanding ground-level decks under 200 square feet in some zones may be exempt, but it's worth confirming before you build.
Beyond code compliance, permits protect you in two important ways. First, an inspected deck is a structurally verified deck — the inspector confirms it's safe before you use it. Second, unpermitted decks are a major issue when selling your home. Buyers' inspectors find them, lenders sometimes won't finance homes with unpermitted structures, and you may be required to tear it down or pay for retroactive permitting.

Decks 30 inches or more above grade require a guardrail at least 36 inches tall for residential decks (42 inches for commercial). Balusters must be spaced no more than 4 inches apart. The handrail on stairs must be graspable and between 34 and 38 inches above the stair nosing.
Pool enclosures have additional requirements — self-closing, self-latching gates and minimum fence/barrier heights. If your deck is part of a pool area, additional permits and inspections are required.
If your neighborhood has an HOA, their rules apply on top of city codes. HOAs can restrict deck size, material, color, and style. Always check your HOA covenants before starting. We'll remind you to do this during our estimate visit.
